FAQ

Here are some of the most frequently asked questions we get:

Do you need representation in civil litigation cases such as personal injury, medical malpractice, slip and fall, wrongful death, and general negligence?

What do I do immediately after a motor vehicle accident?
  1. Stay at the scene in a safe place;
  2. Call the police to report the accident and all of your potential injuries and symptoms;
  3. Get the names and insurance information on all other vehicles and drivers in case they leave before the police arrive;
  4. Take photos of the property damage and license plates if you are able to;
  5. Get a medical evaluation as soon as possible by the ambulance, hospital, or another medical provider you choose;
  6. Contact your attorneys at our firm so we can immediately begin the necessary paperwork and preserve the evidence. Do not give a recorded statement or sign anything from an insurance company.
What do I do immediately after a slip, trip, or fall?
  1. Report the slip, trip, or fall and all of your potential injuries and symptoms to the owner or manager of the property where the accident happened;
  2. Get the names and phone numbers of anyone that saw the incident or spoke to you about it;
  3. Take photos of the scene as soon as you are able to;
  4. Get a medical evaluation as soon as possible by the ambulance, hospital, or another medical provider you choose;
  5. Contact your attorneys at our firm so we can immediately gather and preserve all evidence. It is especially important to contact us right away after an injury occurs on a property. Do not give a recorded statement or sign anything from an insurance company.
What are common accident injuries that your firm handles?

There are many injuries that can occur due to the fault of another. Some of the most common we handle are broken and fractured bones, herniated disks, neck and back injuries, torn tendons and ligaments, shoulder and knee injuries, foot and hand injuries, concussions, brain injuries, and death. We are experienced in working with our clients’ chiropractors, therapists, orthopedic surgeons, neurosurgeons, and neurologists.

How much does it cost to hire your law firm?

Clients pay nothing when they hire our personal injury lawyers. We quickly get to work on your case. We do not get paid until we resolve your case and win you a settlement. We work on a “contingency fee” basis, which means that if we recover money damages the attorney’s fees will come out of the settlement amount paid by the at-fault party. If we are not able to recover money damages, you do not owe us anything. There is no risk in hiring us; and clients who hire personal injury lawyers almost always recovered more than they would have without one.

How do I get my vehicle repaired after an accident?

As a courtesy to our clients, we will assist you with the entire property damage claim along with your personal injury claim. Just give us the name of the at-fault driver, owner, their insurance company, and your own insurance card. We will begin working on your repair or replacement and rental vehicle.

What is the Florida “No Fault” auto insurance law? Do I get $10,000?

This means that regardless of who caused the car accident, your own insurance company is obligated to pay for, typically, up to the first $10,000 of your medical treatment. Your insurance company will make these payments directly to the medical provider. You must have medical treatment within 14 days of your accident in order to have your insurance cover this portion of your medical treatment. Under Florida law, if you own a motor vehicle you are required to have Personal Injury Protection (PIP) Insurance. You should still hire us to make a successful claim against the at-fault person's insurance policy for injuries and additional compensation.

How much insurance money is available for my auto accident injury claim?

Bodily injury (BI) coverage is the coverage on the at-fault persons’ auto policy that will compensate you for your injuries. You will be able to recover up to the amount of that particular policy’s limits (this can be anywhere from $10,000 to $50,000 to $1,000,000). We will be able to tell you how much BI insurance the other side has once you give us their name and the insurance company from the driver’s exchange paperwork you received at the accident scene. Unfortunately, BI insurance is not required in Florida. South Florida has a large percentage of uninsured/underinsured drivers which would leave you with no way to get compensation. Therefore, it is important to purchase uninsured motorist coverage (UM/UIM) from your own insurance company. If you have UM on your policy, your own insurance company can compensate you for injuries caused by someone who had too little or no insurance of their own. You can guarantee that you are protected in case you are injured in a crash if you get this additional UM coverage before being involved in a crash.

What is the average personal injury settlement amount?

A settlement depends on many different factors including the type of accident, the type of injury, whether surgery is necessary, the amount of medical bills in the past and the future, your age, lost income, pain and suffering, the extent of fault of the other party, and the credibility of all witnesses. Our experienced attorneys will be able to review your case and advise you on potential outcomes. No attorney can guarantee that you will get an exact amount of money. You should be very skeptical of any attorney that claims that they can get you a specific amount. We however can guarantee that we will recover more of the maximum amount of compensation for your injuries.

Does the COVID-19 pandemic affect my injury case?

If you are a personal injury victim you should pursue your claim and treatment even during this time. Preserving your claim and seeking medical attention immediately after any type of injury is critical to your case. Waiting too long to address your accident injuries can also cause additional injuries. Doctors are actively seeing new accident patients both in person and virtually right now. Insurance companies are still evaluating and paying compensation on claims. Our attorneys have continued to file lawsuits. We will meet you outside, in person, over the phone, or virtually.
